The Bharatiya Sakshya Adhiniyam, 2023 (BSA) is a landmark piece of legislation that repeals and replaces the more than 150-year-old Indian Evidence Act, 1872. Its primary goal is to modernize and consolidate the law of evidence in India, making it more relevant to contemporary legal challenges and technological advancements.

A key feature of the BSA is its increased emphasis on digital evidence. The new law provides clear and detailed provisions for the admissibility and proof of electronic records, communication, and other forms of digital evidence, a critical change from the old act. It also introduces new definitions and modifies existing ones to streamline the legal process.

The bill was part of a package of three new criminal law bills introduced in Parliament by the BJP-led government, which included the Bharatiya Nyaya Sanhita and the Bharatiya Nagarik Suraksha Sanhita. The BJP's contribution was to initiate and successfully pass this legislative overhaul, which aims to replace colonial-era laws with a new legal framework that the government has stated is centered on justice rather than punishment.
